Ontario introduced a rule requiring International Medical Graduates to have completed two years of Ontario high school to apply to the CaRMS R1 residency match. An Arbitrary and Un-Canadian Policy

In October, the Government of Ontario introduced a policy restricting IMG applicants, who are already limited to Canadian Citizens and Permanent Residents, by requiring two years of Ontario high school to apply for residency.

  • This rule does not measure competence.
  • It does not measure performance.
  • It does not measure commitment to Ontario patients.
  • It measures where someone attended high school.

As a result, many highly qualified candidates are excluded, including:

  • Canadians raised in other provinces who completed medical school abroad
  • A medical student born in Alberta who studied medicine in Ireland
  • A fully trained physician from South Africa who is now a Canadian permanent resident seeking to retrain
  • A new Canadian citizen who immigrated from India, completed a PhD, and is committed to practicing here

There is no evidence that high school location predicts physician retention or performance. Yet this policy closes the door on doctors our health system urgently needs.

What the Court Has Said

A constitutional challenge was filed in the Superior Court of Ontario.

In December, the Court granted an injunction pausing the policy for the 2026 CaRMS match. The Court determined there is a strong case that the rule:

  • Violates Charter rights of equality and mobility
  • Causes irreparable harm to IMGs
  • Harms Ontario's health system

The full constitutional hearing is now underway to permanently overturn the rule. But litigation at this scale requires community support.
